(ORAL) Five (5) petitioners namely Om Singh, Pehal Singh, Ramesh, Zile Sigh and Balkishan, residents of village Nanhera, Tehsil Bapoli, District Panipat, through the instant writ petition are seeking a mandamus directing the Deputy Commissioner, to take action against the Patwari, for making illegal entries during the consolidation proceedings wherein some status quo order is stated to have been passed. CWP-2070-2019 (O&M) The Sub Divisional Officer (Civil), Samalkha, vide memo dated 19.3.2018 (Annexure P2), has written to the Deputy Commissioner, Panipat that the Patwari, has made certain changes in the Gurdawaris of the land included in the consolidation proceedings by ignoring the stay orders and without seeking guidance from the higher authorities.

We have heard the counsel for the petitioners. Neither the copy of stay order has been placed on record nor the scope and extent of stay order has been mentioned in the report dated 19.3.2018 (Annexure P2). Merely on the basis of some changes in the revenue entries and in the absence of any material and information to substantiate the same, we are not inclined to pass a direction for initiating any action against the Patwari. At this stage, counsel for the petitioners prays for permission to withdraw the instant writ petition. Dismissed as withdrawn.
