 This petition has been filed challenging order dated 01.05.2018, whereby application under Order 1 Rule 10 CPC has been dismissed by the learned Rent Controller, Chandigarh besides directing the eviction of the tenant i.e. respondents No.2 and 3 in this petition. It is not in dispute that an appeal has been filed by the petitioner challenging the consolidated order of eviction as well as dismissal of her application under Order 1 Rule 10 CPC before the learned Appellate Authority.

In this view of the matter, learned counsel for the petitioner seeks to withdraw this petition with liberty to pursue the appeal filed by the petitioner.

Petition is accordingly dismissed as withdrawn with liberty aforesaid.
