ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.87 dated 08.12.2018, registered under Section 409 of the Indian Penal Code (in short 'IPC') at Police Station Qila Lal Singh, Police District Batala, District Gurdaspur.
The operative part of the order dated 25.01.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner has submitted that the petitioner is ready to deposit half of the disputed amount in the account of Gram Panchayat, Dharamkot Bagga, Block Batala within a period of 01 month from today. Notice of motion for 14.03.2019...."
Counsel for the petitioner submits that the petitioner has submitted that the petitioner has appeared before the Investigating Officer and has joined the investigation. It is further submitted that the MOHD YAKUB 2019.03.14 16:29 I attest to the accuracy and integrity of this document
CRM-M No.3564 of 2019 petitioner has deposited an amount of Rs.3,19,168/- in the account of Gram Panchayat, Dharamkot Bagga, Block Batala. Counsel for the State, on instructions from HC Bachittar Singh, has not disputed the factual position. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 25.01.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
