Mr. Sandeep Kotla, Advocate for the petitioners. *** Daya Chaudhary, J. (Oral) Learned counsel for the petitioners submits that in spite of making all efforts to lead evidence, the report of hand writing expert could not be prepared on that day upto 4.30 pm and it was submitted on the same day at about 4.45 pm but by that time, case was adjourned to next date. The petitioner in fact could not avail two opportunities because of the reason as mentioned above and only one effective opportunity is required.

Keeping in view the submissions made by learned counsel for the petitioner that he would be able to place on record the document within one effective opportunity; without issuing any notice to the other party as it may not only cause inconvenience but financial implications would also be there and on perusal of impugned order as well as stand taken in the application, the present revision petition is allowed and the trial Court is directed to allow the petitioner to place on record the required document by giving one effective opportunity subject to payment of costs of `2000/- to be deposited with the trial Court.
