ANIL KSHETARPAL, J. (Oral) Defendant-petitioner is in revision petition against the order by which the learned trial Court has allowed the application for amendment of the plaint so as to clarify the boundaries of the suit property. Learned counsel for the petitioner has vehemently argued that the suit is not maintainable. He has further submitted that the Court has given certain observations, which are not in accordance with law. I have considered the submission of learned counsel. At the stage of allowing amendment of the plaint, Court is not to examine whether the suit is maintainable or not. Any observation made by the Court while deciding the application is only for the purpose of decision of the application which would not affect the merits of the case. Hence, this revision petition is dismissed.
