(ORAL) Petitioner herein seeks issuance of a writ in the nature of mandamus directing respondent No.2 to consider his name in the category of dependent of Disabled Ex-servicemen (Disabled ESM-General), asserting that inadvertently he applied in the category of dependent of Ex-servicemen (ESM- General).

Petitioner also submitted a representation dated 19.01.2022 but the same has not been adverted till date. Hence, the instant petition. 3.

Learned counsel for the petitioner submits that selection process is yet to complete and it is not a case of change of category post result, so as to take any undue advantage. At this stage, the candidates have merely been called for scrutiny of documents on 10.02.2022 and 11.02.2022. He argues that respondents ought not to take unduly harsh view of the online inadvertence committed by the petitioner while clicking the mouse of the computer and should consider candidature of petitioner in the category of dependent of Disabled ESM-General.

On advance service, learned State counsel joins proceedings and opposes issuance of notice of motion and submits that competent authority shall take decision either way, on the pending representation of the petitioner, in due course.

Learned counsel for the petitioner also agrees that let a final decision be taken, by the competent authority on the pending representation dated 19.01.2022.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per representation dated 19.01.2022 and also by keeping in view the contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of 30 days from today or before the declaration of result, whichever is earlier. 9.

Disposed of accordingly.
