This revision petition has been filed under Article 227 of the Constitution of India challenging the order dated 22.11.2024 (Annexure P-5) passed by the learned Civil Judge (Jr. Division), Dasuya whereby the application filed by the petitioner under Order 7 Rule 11 CPC has been rejected. 2.

Learned counsel for the petitioner submits that since in the present case, the trial Court has framed the issue of jurisdiction as a preliminary issue, thus, he wishes to withdraw the petition with liberty to take all the pleas, which have been raised in the present petition and are available to them before the trial Court.

In view of above, present petition is dismissed as withdrawn, with the aforesaid liberty.
