RAJ MOHAN SINGH, J.(Oral) Earlier CRM-M No.24368 of 2020 was dismissed on merits after prima facie consideration of the material collected by the prosecution.

The petitioner was found in the company of the deceased Parveen, who left the shop of DJ system at 12:10 AM. The deceased was found present in the vehicle, in which the DJ system was installed. The prosecution witnesses viz. Prince PW-6 and Mohit PW-7 have supported the case of the prosecution alleging that the petitioner and the deceased had left the shop at 12:10 AM. Last seen version has been corroborated by the aforesaid witnesses.

In pursuance of the disclosure statement of the petitioner, the recovery of rod has been effected. The statement PRINCE SAINI 2022.04.22 16:21 I attest to the accuracy and integrity of this document



   of Dr. Bijender Singh PW-4 would be considered by the trial Court in accordance with law.

Since the earlier petition was dismissed on merits, therefore, no ground is made out to grant any indulgence in favour of the petitioner.
