The order passed by the Rent Controller, Nabha is under challenge in this revision petition whereby defence of revision petitioner was struck off as he failed to file reply despite grant of several adjournments during the period of six months.

Learned counsel for the respondent submits that though the delay was deliberate and intention was only to delay the proceedings, still he has no objection if the revision petitioner is allowed to file written statement subject to payment of costs.

In order to facilitate the revision petitioner to contest the ejectment petition on merits and in view of the submissions made by learned counsel for respondent, this revision petition is allowed subject to payment of `5,000 as costs which will be deposited with the Punjab Legal Services Authority, Chandigarh. The Rent Controller will grant one opportunity to the revision petitioner to file written statement and after filing of written statement proceed and decide the ejectment petition expeditiously.
