*** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance of the petitioners, who are running the floor mills, is that Mobile Floor Mills, which are being run on tractor/tractor-trollies, is contrary to the order passed by this Court in CWP-11664-2001 titled as 'Babu Singh Vs. State of Punjab and others', decided on 21.08.2002.

Learned counsel for the petitioners argues that despite the fact that the proof has been submitted with regard to running of illegal Mobile Floor Mills, but no action has been taken by the Deputy Commissioner, Fazilka-respondent No.3 and due to the running of the said Mobile Floor Mills, business of the petitioners is severely prejudice. Prayer of the petitioners is for issuance of direction to respondent No.3 for taking an appropriate action against the illegal Mobile Floor Mills, which are being run by the violators of law.

CWP-3942-2020 -2Counsel for the petitioners states that for the relief, which is being claimed in the present writ petition, petitioners have submitted the representations dated 29.08.2009 and dated 03.09.2019 (Annexures P-5 and P-7) respectively, which are still pending consideration with respondent No.3 and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to respondent No.3 to decide the said representations by passing an appropriate speaking order. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, respondent No.3 is directed to decide the representations dated 29.08.2009 and dated 03.09.2019 (Annexures P-5 and P-7) respectively by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
