Interim orders are permitted to be taken on record. Vide impugned order the evidence of the plaintiffpetitioner has been closed by order in a case which is pending since 2005.

The short question which is required to be determined before the trial Court is whether the plaintiff- petitioner is entitled to retiral benefits as claimed by him. As the matter has been pending since 2005 and issuance of notice and disposal thereafter would delay further proceedings.

In the interest of justice, this petition is disposed of with a direction that the plaintiff-petitioner will be given two effective opportunities to produce his entire evidence subject to payment of RAJ KUMAR ARORA 2015.03.18 16:59 I attest to the accuracy and integrity of this document

CR-7499-2013 (O&M) costs of Rs.1,000/-. It is ordered that in case the plaintiff- petitioner is not able to conclude his evidence in two effective opportunities granted within a period of two months, this petition will be deemed to have been dismissed.

Since the petition has been disposed of in limine to save the time and expenses, it will be open to the defendantrespondent to approach this Court in case it is not satisfied with the order.
