CWP-1773 of 2023 1.

The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondent No. 2 to re-issue/renew passport of the petitioner which was issued on 27.10.2005 and valid upto 26.10.2015.

The petitioner was convicted by Additional Sessions Judge, SBS Nagar for commission of offence under Section 18 of the PARAMJIT KAUR SAINI 2023.07.18 17:43 I attest to the accuracy and authenticity of this order/judgment

CWP No. 1773 of 2023 (O&M) -2- 2023:PHHC:089695 NDPS Act. He was sentenced to imprisonment of 10 years. The petitioner preferred CRA-S-1392 of 2011 along with an application seeking suspension of sentence before this Court. This Court vide order dated 01.10.2013 has suspended sentence of the petitioner and appeal of the petitioner is still pending before this Court. 3.

This Court vide judgment dated 14.07.2023 passed in CWP No. 27167 of 2018 has disposed of identical issue. 4.

On being confronted with the aforesaid fact, Mr. Ankur Sharma, Senior Panel Counsel for Union of India concedes that facts of the present case are identical to case of Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018 disposed of vide judgment dated 14.07.2023.

The issue involved in the present case is squarely covered by judgment of this Court dated 14.07.2023 passed in CWP No. 27167 of 2018.

The instant petition stands disposed of in view of aforesaid judgment and passport authorities are directed to pass order in the same terms.
