RITU BAHRI J. (Oral) This petition under Article 227 of the Constitution of India is for setting aside order dated 14.08.2017 (Annexure P-4) passed by the learned Addl. Civl Judge (Sr. Divn.)-sum Sub Divisional Judicial Magistrate, Ellenabad, District Sirsa whereby State of Haryana as well as SDO (Civil) cum Prescribed Authority, Ellenabad was impleaded as defendants . Learned counsel for the petitioners submits that pursuant to the impugned order, State has put in appearance and filed written statement as well In view of the above factual position, at this stage, order dated 14.08.2017 (Annexure P-4) passed by the learned Addl. Civl Judge (Sr. Divn.)-sum Sub Divisional Judicial Magistrate, Ellenabad, District Sirsa does not require any interference by this Court.

The petition is dismissed.

However, the learned Trial Court shall proceed in the case and liberty of hearing be given to the parties, in accordance with law.
