1. Today, at the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition at this stage with liberty to file afresh in case there is inordinate delay in conclusion of trial.

2. In view of the aforesaid request, the present petition is dismissed as withdrawn with liberty aforesaid.

3. Since, the learned counsel for the petitioner has expressed his apprehension of delay on account of the fact that co-accused is yet to be arrested and that upon his arrest a de novo trial would commence, it is directed that in case of MOHAN SINGH 2024.02.07 01:25 I attest to the accuracy and integrity of this order/judgment

CRM-M-4532-2024 (O&M) ( 2 ) 2024:PHHC:016284 such an eventuality i.e. a co-accused being arrested and a supplementary challan being filed, the trial Court shall consider the feasibility of segregating the trial of any such co-accused.
