The application to set aside the order dismissing the suit for default under Order 9 Rule 2 CPC has been dismissed. The counsel points out that the Court has wrongly observed that the munadi had not been effected when it had been done. The non appearance of the counsel for the plaintiff was only on account of the fact that a wrong date had been noted. I dispense with notice to the respondents since there has been no consideration of the case on merits. No prejudice could be caused to the respondents. I set aside the order already passed and restore the suit to its file for taking up further process in suit in accordance with law.

The civil revision petition is allowed.
