AT CHANDIGARH CR No.7770 of 2016 Date of decision:22.11.2016 Rachhpal Singh and another ... Petitioners Vs.
Smt. Karamjit Kaur and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL Present:- Mr. Alok Mittal, Advocate for the petitioners.
AMIT RAWAL J. (Oral) Mr. Alok Mittal, learned counsel for the petitioners submits that caveator/plaintiffs are aggrieved of the pendency of the appeal bearing No.54 dated 01.06.2013 filed against the judgment and decree dated 17.05.2013 passed by the then Additional Civil Judge, Senior Division, Derabassi in civil Suit No.130 of 2005/2008, vide which the suit for possession by way of specific performance and injunction, has been decreed. In this regard, zimni orders, Annexure P-4, (from page 124 to 159) have been placed on record to indicate the factum of pendency of the appeal.
I am of the view that the appeal against the judgment and decree cannot be kept pending adjudication for a period of three years and most of the miscellaneous applications are with regard to bringing on record the LRs, nothing beyond.
