In view of the averments made in the application, same is allowed and the requisite documents are taken on record. Main case CM-7053-CII-2025 has been filed for withdrawal of the revision petition, with liberty to revive the petition, in case of restoration of the civil suit.

It is submitted by the counsel for the petitioner that the civil suit filed under Order 33 CPC, has since been dismissed in default, on account of non-appearance of the respondents (plaintiffs before the court below), vide order dated 19.03.2025, copy whereof is Annexure P-7. CR-7418-2018 Keeping in view the averments made in the application, same is allowed and in view of the order passed on an application under Order 6 Rule 17 CPC, counsel for the petitioner submits that he does not want to pursue with the present revision petition and the same be dismissed as withdrawn, with liberty to revive the same, in case of restoration of the suit. Ordered accordingly.
