**** ANOOP CHITKARA, J. (ORAL) Learned State counsel opposes this petition on the ground that father of the injured, who is expired due to other causes, was an eye witness and he is not a signatory to the compromise. He submits on instructions from ASI Gurdev Singh that there is no compromise at all.

Given above, learned counsel for the petitioner wants to withdraw the present petition to explore the possibilities of compromising the matter with legal heirs of injured, who subsequently died and once such compromise takes place, he be permitted to file a petition for quashing.

These are the statutory rights and are well effected in the table of Section 320 Cr.P.C, as such, the present petition is disposed of with liberty to come again after filing compromise.
