The suit for specific performance which was restored to file is subject for challenge. The matter involves a claim to right to a fairly valuable property and if the Court has exercised the discretion accepting the averment as regards some illness of the plaintiff as a justifying circumstance, I will not make an interference only because that there was no medical evidence adduced to prove that illness. Let there be an adjudication on merits and there is no need for interference with the exercise of discretion made by the court below. 2.

The revision petition is dismissed.
