Manoj v. State Of Haryana
2024:PHHC:012831
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH (104) CRM-M-4881-2024 Date of Decision:-31.01.2024 Manoj ......Petitioner
Versus
State of Haryana ......Respondent CORAM: HON'BLE MR. JUSTICE ALOK JAIN
Present:
Mr. S.S. Sahu, Advocate for the petitioner.
Mr. Tanuj Sharma, AAG, Haryana.
**** ALOK JAIN, J. (Oral) 1.
The present petition is the second petition for grant of anticipatory bail to the petitioner in case FIR No. 237 dated 12.04.2023 under Section 379 of the Indian Penal Code, registered at Police Station Section 10, Gurugram, Tehsil and District Gurugram, after the first one was dismissed after arguing vehemently on merits of the case and was withdrawn and more so, the petitioner was to surrender on 08.11.2023 but has volunteered not to abide by the order passed by this Court. 2.
The only ground raised by the petitioner now is that he has been acquitted in the other two FIRs and in those FIRs the petitioner was nominated on the basis of a disclosure statement and a similar modus operandi was narrated. However, that cannot be a ground for grant of any concession to the petitioner in the present FIR. More so, the petitioner has violated the orders passed by this Court on 06.11.2023 and did not surrender on 08.11.2023 i.e. the date on which no orders of acquittal were PARUL 2024.02.02 14:15 I attest to the accuracy and authenticity of this document there in his favour.
2024:PHHC:012831 CRM-M-4881-2024 -23.
A person who violates the law cannot be said to have approached the Court with clean hands and considering the antecedents of the petitioner against whom other similar cases have also been lodged, I do not find it a fit case where the extra ordinary concession of anticipatory bail can be granted.
4.
In light of the above, the present petition stands dismissed. (ALOK JAIN) JUDGE January 31, 2024 Parul Whether speaking/reasoned:- Yes/No Whether Reportable:- Yes/No PARUL 2024.02.02 14:15 I attest to the accuracy and authenticity of this document
