Rajan Gupta, J (Oral) Challenge in the present revision is to order dated 12.8.2016 whereby evidence of the plaintiff was closed by order. It has been urged before the court that PWs remained present before the court on various dates. Thereafter, case was repeatedly adjourned due to the fact that their cross examination was deferred.
Learned counsel for the petitioner submits that two opportunities may be granted to him to conclude the evidence. Keeping in view the facts and circumstances of the case, prayer is accepted. Plaintiff may be granted two opportunities by the trial court to conclude his evidence. It shall, however, be subject to payment of Rs.15,000/- as costs to be remitted to respondent No.1. Trial court would conclude the proceedings expeditiously and in any case not later than two months.
Petition is allowed in these terms.
