(Oral) The petitioner-plaintiff has challenged the order dated 12.10.2015 (Annexure P-1), whereby, an application filed under Order 6 Rule 17 of the Code of Civil Procedure, seeking amendment of the pleadings and prayer clause to challenge the award passed by the Collector under the Erstwhile Land Acquisition Act, has been declined.

It is settled proposition of law that Civil Court did not have the jurisdiction to try and entertain the suit seeking challenge to the Award.

Confronted with the situation, learned counsel for the petitioner seeks permission of this Court to withdraw the present revision petition with liberty to challenge the same in the competent Court of law.

Ordered accordingly.
