**** AJAY TEWARI, J.(Oral) This revision has been filed against the order of Civil Judge declining an application under Order 6 Rule 17 filed by the appellanttenant. The case of the respondent-landlord was that the petitioner was a tenant at the rent of Rs. 2800/- per month while the case of the petitioner-tenant was that he was a tenant at the rate of Rs.500/- per month. Against the order of the provisional assessment he filed an appeal where he again claimed that he was tenant at the rate of Rs. 500/- per month and thereafter this application was filed after four witnesses having been examined by the respondent to claim amendment to the effect that the rate of rent was Rs. 700/-. The ground taken was that he had discovered the rent note which so stipulated. In my opinion, the petition must fail. Regardless of the rent note, the fact of the matter is that as per the petitioner earlier his claim
Anuradha 2018.03.16 10:29 I attest to the accuracy and integrity of this document CR-751 of 2018 (O&m) was that he was tenant at the rate of Rs. 500/- per month and now his claim is that he is tenant at the rate of Rs. 700/- per month. This document on which now he has placed reliance was in his possession and the story that he found it and then realized that the rent was Rs.700/- is extremely hard to stomach.
Consequently, no fault can be found with the order of the Civil Judge. The civil revision stands dismissed. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
