The present petition has been filed seeking grant of anticipatory bail to the petitioner in FIR No. 112 dated 07.07.2022 under Sections 323, 324, 148 and 149 of the Indian Penal Code, 1860 (Sections 325 and 326 IPC added later on vide DDR No. 56 dated 08.09.2023) registered at Police Station Sardulgarh, District Mansa (Annexure P-1). 2.

After arguing vehemently on the merits of the case, learned counsel for the petitioner prays for withdrawal of the present petition. 3.

Accordingly, the present petition stands dismissed as withdrawn, without expressing any opinion on the merits of the case. 4.

Although the petition has been dismissed as withdrawn, however, it is pertinent to bring on record the State of affairs of the authorities in proceeding with the matter as the present FIR was lodged in the year 2022 and the offence under Section 325 and 326 IPC were added PARUL 2024.03.04 11:32 I attest to the accuracy and authenticity of this document

2024:PHHC:012790 CRM-M-4860-2024 -2on 08.09.2023 i.e. after more than 01 year 02 months and even thereafter, no action has been taken by the authorities to apprehend the petitioner for the last almost 05 months.

The first anticipatory bail came to be dismissed by the Court of Sessions Judge, Mansa on 09.10.2023 and the petitioner instead of taking immediate steps to approach this Court, took almost 04 months to file the present petition. However, nothing is being commented on the same, in light of the fact that the petitioner has withdrawn the present petition. 6.

Copy of this order be sent to the concerned SSP for following up the matter with the Investigating Officer as to what steps were taken in last 05 months to apprehend the petitioner and what is the reason for his non-arrest.
