Respondent had filed the petition under Section 13 of East Punjab Urban Rent Restriction Act, 1949 seeking ejectment of the petitioners from the premises in question. Learned Rent Controller vide order dated 8.5.2009 allowed the ejectment petition. Aggrieved against the said order, petitioners preferred an appeal and the same was dismissed by the Appellate Authority vide judgment dated 28.8.2012. Hence, the present petition by the petitioners-tenant.

After arguing for sometime, learned counsel for the petitioners has submitted that he does not press the revision petition on merits and prayed that the petitioners be granted time upto 30.4.2016 to vacate the demised premises as they were in possession of the premises in question for a number of years and the shop in question was the only source of livelihood of the petitioners.

Civil Revision No. 786 of 2013 (O&M) -2- The request for grant of time upto 30.4.2016 for vacation of the shop has not been opposed by the learned counsel for the respondent.

In view of submissions made by the learned counsel for the parties, this revision petition is dismissed on merits. However, the petitioners are granted time to vacate the demised premises on or before 30.4.2016. This order shall operate subject to filing of an undertaking by the petitioners in this regard before the learned Rent Controller within 15 days from the date of receipt of certified copy of this order and on making payment of the entire arrears of rent, if any due, within a period of 4 weeks from today and shall also keep on paying the rent of ensuing months up to 30.4.2016 to the respondent on or before 10th of each calendar month.
