CR-799-2015 After arguing for some time, learned counsel for the petitioners seeks permission to withdraw this petition with prayer that petitioners be allowed reasonable time for vacating and handing over the vacant possession of the demised premises to the respondent-landlord. CR-799-2015 -2Mr. Atul Lakhanpal, Senior Advocate with Mr. Arjun Lakhanpal, Advocate, who is present in the Court, accepts notice on behalf of respondent and agrees with the proposal as put forth by learned counsel for the petitioners to the extent that the respondent has no objection in allowing of time upto 31.08.2015 to the revision petitioners to vacate the demised premises.
In view of request made by learned counsel for the petitioners, this petition is dismissed as withdrawn. The revision petitioners are allowed period upto 31st August, 2015 to vacate the demised premises, subject to the following terms:- (i) The petitioners-tenant will pay/deposit the entire due rent and mesne profits, if already assessed by the Appellate Authority, upto 31st August, 2015 within four weeks.
(ii) They will file affidavit before the executing Court within five weeks giving details of entire payment of rent and mesne profits, if assessed by the Appellate Authority and undertaking to vacate and hand over the vacant possession of the demised premises to the respondentlandlord on or before 31st August, 2015. In case of default of any of the above terms, the respondentlandlord will be entitled to execute the order of ejectment forthwith. ( SURINDER GUPTA ) February 26, 2015.
