**** SANJAY VASHISTH, J. (Oral) This appeal has been filed by appellant- Mal Singh, against the judgment of conviction and order of sentence dated 05.06.2004 passed by learned Judge, Special Court, Patiala, passed in Sessions Case No. 105T of 09.03.2001/08.12.2003, arising out of FIR No. 199 dated 12.12.2000, under Section 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985, registered at Police Station Ghagga.
At the very outset, learned State counsel, on instructions from SI Amrinder Singh, Pairvi Officer, Patiala, submits that during the pendency of the present appeal, appellant- Mal Singh, has expired on 01.10.2014. In this regard, he has furnished photocopy of the death certificate bearing registration No. 355 dated 07.10.2014, issued by Sub Registrar, Birth & Death, Municipal Council, Sunam. The said certificate is also accompanied by report dated 20.03.2023 prepared by ASI Gurmeet Singh, Incharge, Police Post, Badshahpur, and statement dated 15.03.2023 of son of appellant- Mal Singh, namely, Sunny Singh. Said documents are taken on record. Registry is directed to tag the same at an appropriate place. Mr. B. S. CRA-S-1365-SB-2004 (O&M) - 2 - position to dispute the factum of death of appellant- Mal Singh, as disclosed by learned State counsel with the support of said documents. In view of the above, present appeal i.e. CRA-S-1365-SB-2004 stands abated qua the appellant- Mal Singh, subject to the conditions laid down in the case of "Shivji Ram @ Dimple Vs. State of Punjab" (IOINCRA-S-4686-SB-2018 in CRA-S-4686-SB-2018, decided on 24.11.2022, 2022 SCC OnLine P&H 3759: Law Finder Doc ID #2076392). Appeal stands disposed of.
