**** MANJARI NEHRU KAUL, J. (Oral) The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No. 664, dated 13.12.2018, under Sections 498-A, 406, 323, 34 IPC, registered at Police Station Model Town, district Rewari.

As per report received from the Mediation and Conciliation Centre of this Court, the parties have arrived at an amicable settlement. This Court has been apprised by the counsel appearing on for the parties that subsequent to the settlement arrived at between the parties, they have filed a joint petition under Section 13-B of the Hindu Marriage Act, 1955, seeking divorce by way of mutual consent and first motion statements too have been recorded before the Family Court at Rewari. It has further been submitted that in compliance to order dated 25th March, 2019, an amount of ` 3,00,000/- has been deposited by the petitioner before the Court below at Rewari.

CRM-M-3731-2019 (O&M) - 2 - Learned counsel for respondent No.2 (complainant) prays that the said amount be released to respondent No.2 (complainant). In view of the compromise having been arrived at between the parties, the factum of which is not controverted by the learned State counsel as well, the instant petition is allowed. The interim order dated 25th March, 2019, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.

Since the amount of ` 3,00,000/- has already been deposited by the petitioner before the Court below, respondent No.2 (complainant) shall move an appropriate application before Court concerned for release of the said amount.
