The petitioner Shyam Lal, aged 67 years, has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.423 dated 24.12.2021 under Sections 279, 323, 336 of Indian Penal Code and Section 3(1)(S) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station Bilaspur, District Yamuna Nagar. 2.
At the time of issuance of notice of motion on 7.2.2022, the following order was passed :
"Learned counsel contends that as per the allegations in the FIR, a vehicular accident took place and the complainant, who was riding on a motorcycle was injured. He further submits that the petitioner being driver of the offending vehicle has been falsely implicated for the alleged commission of offence punishable under Section 3 Scheduled Castes and the Scheduled Tribes KAMAL KUMAR 2022.07.29 16:50 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-4855-2022 (O&M) (Prevention of Atrocities) Act, 1989 as in the given facts, no such offence would be made out.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. At this stage, Mr. Inderjeet Singh, Advocate appears on behalf of the complainant. "

Learned State counsel, upon instructions from DSP Ashish, has informed that pursuant to interim directions issued by this Court the petitioner has since joined investigation and is not required for any custodial interrogation and that he is not involved in any other case.

Having heard the learned counsel for the parties and bearing in mind the facts and circumstances of the case and also that the petitioner has already joined investigation and is not required for any custodial interrogation, the present petition is accepted and the interim directions issued by this Court vide order dated 7.2.2022 are hereby made absolute, subject to the condition that the petitioner shall continue to join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 29.7.2022 ( Gurvinder Singh Gill ) kamal Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No KAMAL KUMAR 2022.07.29 16:50 I attest to the accuracy and integrity of this document
