Prayer is for grant of anticipatory bail in cross version case i.e. GD No.24 dated 11.11.2023 vide which the offence under Section 326 of the IPC as been added and offence under Section 325 of IPC was deleted in a cross-version case registered vide Rapat No.51 dated 09.11.2023, under Sections 323, 325, 148, 149 of IPC at Police Station Gharinda in FIR No. 189 dated 30.09.2023, registered under Sections 326, 323, 324, 148, 149, 427 of IPC at Police Station Gharinda, District Amritsar (Rural). 2.

Vide order dated 30.01.2024, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.

Learned State counsel, on instructions from ASI Amalokh Singh submits that the petitioner has joined the investigation and his custodial interrogation is no longer required. Manju 2024.03.21 10:43 I attest to the accuracy and integrity of this document

In view of above, the petition is allowed. The order dated 30.01.2024 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.

However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be construed as parity qua any other co-accused. 6.

It is made clear that, in case, the petitioners are found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
