**** Manjari Nehru Kaul, J.(Oral) This is the second petition filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.19 dated 17.02.2021 under Sections 346 IPC (Sections 363, 366, 376-D, 34 IPC added later on while Section 346 IPC deleted) registered at Police Station Hassanpur District Palwal.

On a pointed query put to learned counsel as to what was the material change in the circumstances subsequent to the withdrawal of previous petition seeking similar relief, learned counsel has failed to satisfy this Court qua any material change in the circumstances. Learned State counsel on instructions from ASI Ash Mohammad has apprised the Court that all the material witnesses including the prosecutrix have supported the case of the prosecution in its entirety. In the circumstances, no ground is made out to extend the concession of bail to the petitioner. Accordingly, present petition stands dismissed.
