IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH C. R No. 7643 of 2017 (O&M) Date of decision : 07.11.2017 Santokh Singh and others ....Petitioners versus State of Punjab and others
...Respondents
CORAM:
HON'BLE MS. JUSTICE RITU BAHRI
Present:
Mr. Sumeet Puri, Advocate for the petitioners.
**** RITU BAHRI , J. (Oral) Notice of motion.
On asking of the Court, Mr. D.K. Singla, Sr. DAG, Punjab accepts notice on behalf of respondent-State. Learned counsel for the petitioner is directed to supply copy of the petition to the learned opposite counsel by today itself during the course of the day.
Challenge in this petition is to order dated 18.03.2017 passed by learned Addl. District Judge Sangrur.
Learned counsel at the very outset submits that the present petitioners are seeking the same relief as granted by this Court in C.R. No. 4676-2017, decided on 21.07.2017. The present petitioners are aggrieved against the order passed by learned Addl. Sessions Judge, Sangrur wherein the Court has held that the present petitioners are not entitled for solatium as well as interest. In view of the above factual position, order dated 18.03.2017 passed by learned Addl. District Judge Sangrur is hereby set aside, in the same terms as in C.R. No.4676-2017, decided on 21.07.2017. As a result, the objections will be decided afresh strictly in accordance with law, after hearing the parties without reference to this order.
Allowed.
