The prayer in the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, read with Section 482 Cr.P.C. for quashing of impugned order dated 17.12.2024 (Annexure P-8) passed by learned Judicial Magistrate 1st Class, Karnal in case bearing No.CHI/787/2022 arising out of FIR No.1 dated 01.01.2021, under Sections 406, 420, 506 IPC, registered at Police Station Ram Nagar District Karnal vide which petitioner has been declared 'Proclaimed Person'.

Learned counsel for the petitioner submits that the matter was compromised between the petitioner and complainant on 03.02.2023. However, due to wrong advice of counsel, petitioner was remained absconded and failed to appear before the trial Court on 07.05.2024, consequently, the bail of the petitioner was cancelled and non-bailable warrants was issued against him for 21.05.2024. He further submits that proceedings under Section 82 Cr.P.C. were initiated against the petitioner in an illegal and ANIL KUMAR 2025.07.09 17:49 I attest to the accuracy and integrity of this document

CRM-M-4071-2025 arbitrary manner and the petitioner has been declared as proclaimed person vide impugned order dated 17.12.2024 (Annexure P-8). 4.

I have heard learned counsel for the petitioner and perused the material placed on record.

No ground to interfere in the impugned order dated 17.12.2024 (Annexure P-8) is made out and the present petition is hereby, dismissed. 6.

However, the petitioner is directed to appear and surrender before the trial Court concerned within a period of 07 days from today at 10:00 p.m and may file bail application before the concerned Court. In case, he does so, the same be considered and decided by the trial Court concerned, in accordance with law, within a period of 03 days. ( )
