Learned counsel for the petitioner has submitted that petitioner undertakes to hand over the vacant possession of the premises in question to the respondent on or before 01.5.2015 in case respondent agrees to forego the arrears of rent. Learned counsel for the respondent has submitted that the respondent undertakes that he shall not claim the arrears of rent from the petitioner if he (petitioner) vacates the premises in question and hands over the vacant possession to the respondent on or before 1.5.2015.

In view of the submissions made by learned counsel for the respondent, learned counsel for the petitioner has submitted that he may be permitted to withdraw the petition. Dismissed as withdrawn.

However, the parties shall remain bound by their undertaking.
