(ORAL) Learned counsel for the petitioner submitted that as per his instructions, the suit filed by the respondent-plaintiff has been dismissed in default on 19.04.2018 whereas the present revision petition is directed against the order declining the application filed by the petitioner under Order 7 Rule 11 CPC. As of now, no cause of action survives.

In view of the aforementioned circumstances, the revision petition is dismissed as having become infructuous. However, liberty is granted to the petitioner to revive the same in case the suit is restored or already restored.
