There is no justification for the petitioner to arrive to this Court to complain that the side has been closed without giving appropriate opportunity. The justification given by the counsel is that the party had been taken in custody during the time when there had been dates of hearing before the court. The petitioner is at liberty to set forth the same reason and move an application for reopening the case and the trial Court will consider the same and pass approriate orders in the light of law laid down by this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013(1) PLR 404. 2.
The civil revision petition is disposed of with the above observation.
