Case called twice. The learned counsel representing the petitioner did not come forward to attend the hearing. 2.

The petitioner is defendant No.1 in a suit for grant of decree of declaration to the effect that the plaintiff is owner in possession of plot No.

97. The correctness of the transfer deed, executed on 14.06.2018 by the defendant No.1 in favour of defendant No.3, has been challenged. The petitioner and the respondent No.1 are the husband and wife. An application filed by the petitioner for rejection of the plaint under Order VII Rule 11 CPC has been dismissed. The Court has found that the plaint cannot be rejected without giving an opportunity to the parties to lead evidence. It is the case of the plaintiff that she and her minor daughter did not have any other accommodation to reside.

In view of the aforesaid facts, no ground is made out to interfere. Hence, the present revision petition is dismissed. (Anil Kshetarpal) Judge July 04, 2022 "DK"
