The petitioners have approached this Court seeking grant of anticipatory bail in respect of a criminal complaint No.COMI-4192019, dated 26.8.2019 titled as Jaitoon Khan Vs. Rajender Singh and others under Sections 406 and 420 IPC, pending before ACJM, Gurugram, wherein the petitioners have been summoned to face trial for offences under Sections 406, 420 IPC.

Vide order dated 30.1.2020, this Court while issuing notice of motion had directed the petitioners to appear before the trial Court within MOHAN SINGH 2021.11.17 17:27 I attest to the accuracy and integrity of this document

- 2 - CRM-M-3947-2020 (O&M) one week and the trial Court had been directed to release them on interim bail.

Learned counsel for the petitioners has stated at bar that pursuant to interim directions, the petitioners had appeared before the trial Court and had been released on interim bail and have been regularly appearing thereafter.

Learned counsel for the complainant has however, opposed the petition mainly on the ground that the petitioners have been involved in two other cases. However, learned State counsel has been unable to verify the said assertion.

In any case, the instant case arises out of a criminal complaint and there is no occasion for any kind of custodial interrogation. The petition, as such, is accepted and the interim directions issued by this Court vide order dated 30.1.2020 are hereby made absolute subject to the condition that the petitioners shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
