Challenge is to order dated 12.09.2016 passed by Civil Judge (Junior Division), Kaithal. In considered view of the court, order has been passed under Order 39 Rule 1 & 2 as interim prayer is in the same terms as in the main suit. Same needs out right dismissal. Besides, order is appealable in nature.
