Learned counsel for the petitioner states that the petitioner would be satisfied if the present revision petition is disposed off on the undertaking given by the learned counsel for defendant Nos.1 to 4 before the Trial Court that they will not cross-examine defendant No.5, if nothing adverse comes out in his cross-examination by the plaintiff-petitioner. 2.
Learned counsel for respondent Nos.1 to 3 on instructions from Govind Kapoor, Inspector Cooperative Department, Fatehgarh Sahib, states that they stand by the said statement.

Learned counsel for the petitioner has further pointed out that an observation has been made that connivance/collusion if any between the plaintiff-petitioner and defendant No.5 is apparent would go against the plaintiff-petitioner and that such an observation was unnecessary at this stage.

In view of the above and in view of the fact that the impugned order was only a zimni order which has been passed and the only issue in hands was that who would be cross-examining defendant No.5 at the first instance, hence, such an observation was uncalled for and the same accordingly stands expunged.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
