Mehak Jain v. Vijay Kumar Singhal
C.R.No.8170 of 2015 1
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH.
C.R.No.8170 of 2015 Date of Decision: August 23, 2016.
Mehak Jain ....Petitioner
Versus
Vijay Kumar Singhal .....Respondent
CORAM:
HON'BLE MR.JUSTICE RAJAN GUPTA
Present:
Mr.Amit Kumar Jain, Advocate for the petitioner.
Mr.Namit Khurana, Advocate for the respondent.
Rajan Gupta, J (Oral) This revision is directed against the order passed by Additional District Judge, Jind whereby application of the petitioner-wife for grant of maintenance under Section 24 of the Hindu Marriage Act was accepted. Husband was directed to pay Rs.10,000/- per month as maintenance pen dentelite.
Learned counsel for the petitioner has assailed the order. According to him, husband is employed at Bangalore as an Architect and is earning his salary Rs.1,25,000/- per month. The court below thus erred in awarding sum of Rs.10,000/- only as maintenance. This contention has been considered by this court. Stand of respondent before the court below was that petitioner herself is well educated doing a job and is earning about Rs.40,000/- per month.
C.R.No.8170 of 2015 2 Keeping in view the facts and circumstances of the case, I am of the considered view that maintenance payable to the petitioner deserves to be enhanced. Same is fixed as Rs.15,000/- per month. It shall be paid to the revisionist in the same manner as contemplated by the trial court. Petition is allowed in these terms.
(Rajan Gupta) Judge August 23, 2016.
