The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him fresh passport.

The petitioner was issued passport on 10.11.2004 which expired on 09.11.2014. The petitioner in 2007 left India and was sent back on Emergency Travel document. An FIR No. 0017 dated 02.04.2023, under Sections 323, 427, 186, 353, 34 of IPC was registered against the petitioner at Police Station Verowal, District Tarn Taran. The police has not filed its report in the said FIR. The petitioner filed application dated 09.01.2023 seeking fresh passport. The application is still pending. 3.

Mr. Ashutosh Dhankar, counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. He submits that petitioner was issued passport in November' 2004, thus, he can apply for re-issuance of passport whereas petitioner has applied under the category of fresh passport. If the petitioner files a fresh application under the category of re-issuance, the passport authority would look into the application and pass an appropriate order in accordance with law. 5.

In the wake of statement of counsel for Union of India, counsel for petitioner states that the present petition may be disposed of as not pressed.
