By this petition, the petitioner has challenged the notice issued to him under Section 148 of the Income Tax Act, 1961 (Annexure P-3). In our considered view, if the petitioner files reply to the notice issued to him under Section 148 of the Income Tax Act, 1961 (Annexure P-3), it would incumbent upon the Assessing Officer to pass an appropriate order thereon, before proceeding any further.
