Counsel for the applicants-petitioners states that there was an objection raised by the Registry and the documents were taken back and later on they got mixed up with some other documents and could not be traced.

Delay of 104 days in filing the petition is condoned. The application is allowed.

CR-7795-2017 This revision is directed against the order dated 27.4.2017 passed by the Additional Civil Judge (Sr. Division), Loharu whereby defence of defendants No. 1 and 2 was struck off. Counsel for the petitioners contends that the defence has been struck off on 27.4.2017 and the other defendant has been permitted to file the written statement on payment of costs by this Court. The petition is allowed and the petitioners are permitted to file the written statement on or before 15.11.2017 subject to deposit of Rs. 5,000/- which would be paid to the plaintiff.
