The present petition is directed against the order dated 08.10.2018 passed by the Civil Judge (Junior Division), Ludhiana (for short - the Executing Court), through which an application filed by the petitioner, to first frame issues and then adjudicate upon his objection petition, has been dismissed.

After hearing learned counsel for the petitioner, the present petition is disposed of with a direction to the Executing Court to consider the objections filed by the petitioner and if on consideration of the same, the Executing Court finds that there is a serious dispute on facts, which require framing of issues, it may do so and then proceed with the matter in accordance with law.
