IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CR-779-2018 Date of Decision: November 14, 2019 Kunaal Malhotra .....Petitioner

Versus

Jaspreet Kaur ......Respondent CORAM: HON'BLE MS.JUSTICE NIRMALJIT KAUR

Present:

Mr.A.S.Walia, Advocate for the petitioner.

Mr.K.S.Nalwa, Advocate with Mr.A.S.Thind, Advocate for the respondent.

........

NIRMALJIT KAUR, J. (ORAL) The present revision petition is filed against the impugned order vide which the petitioner has been ordered to pay `55,000/- as interim maintenance towards the wife and the minor child. While challenging the said order, learned counsel for the petitioner submitted that he is already paying `50,000/- under Section 125 Cr.P.C. This fact is not disputed. Admittedly, the amount granted under Section 24 of the Hindu Marriage Act, 1955 has to be consolidated alongwith the amount already granted under Section 125 Cr.P.C. Thus, the only amount in excess, which has to be paid, is `5,000/- In view of the same, the present revision petition is dismissed being devoid of merit and the petitioner will have to now pay `5,000/- only, over and above the amount being granted under Section 125 Cr.P.C.
