Present revision is filed for setting aside the impugned order dated 09.09.2017 passed by learned Rent Controller, Ludhiana, whereby application of the petitioner for restoration his ejectment petition, which was dismissed in default, had been rejected. At the outset, learned counsel for the respondent has pointed out that petitioner has a remedy of appeal against the impugned order, therefore, in view of the judgment of this Court ( , 1982 PLR 481), present revision is not maintainable.
Learned counsel for the petitioner is not able to cite any contrary judgment on the point, thus, faced with the situation, he wishes to withdraw the present revision with liberty to take recourse to the remedy of appeal.
In view of the above, present revision is dismissed as withdrawn with liberty to the petitioner to file an appeal before the learned Appellate Authority.

Needless to say, that since the petitioner has been pursuing the present revision under the bonafide impression, therefore, the point of delay in filing the appeal be considered by the Appellate Authority, after taking into consideration this aspect of the matter, expeditiously.
