Petitioner-tenant moved an application before the Rent Controller to summon the concerned official of newspaper 'The Tribune, Chandigarh' with record of advertisement published on 22.04.2007, whereby the demised premises was notified for sale by the respondentlandlord. The application of the petitioner-tenant was declined by the Rent Controller.

I have heard learned counsel for the petitioner. Even if the contention of learned counsel for the petitioner be believed that the demised premises was advertised for sale on 22.04.2007, the ejectment petition was filed in 2015 i.e. after a period of more than 8 years of publishing of this advertisement, as such, this advertisement is not a relevant factor to be looked into while assessing the requirement of landlord of the demised SACHIN MEHTA 2018.11.22 10:18 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH

CR-7805-2018 -2premises for his personal need. The need of a person changes from time to time. A person who intended to sell his property at a particular point of time, may change his mind and think of starting some business in that commercial property after lapse of 8 years. I am of the opinion that the application filed by the petitioner is frivolous and has been filed only to gain time.

This petition has no merits. Dismissed.

Nothing observed in this petition shall be treated as expression of opinion on merits of the case.
