ARVIND SINGH SANGWAN, J. (Oral) Prayer in these petitions is for grant of regular bail to the petitioners under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.52 dated 22.05.2018, for offence punishable under Sections 308, 323, 341, 379, 148, 149, 120-B of the Indian Penal Code, 1860 (in short 'IPC') registered at Police Station Sadar Faridkot, District Faridkot.
Counsel for the petitioners have submitted that while framing the charge, the trial Court has added Section 325 IPC as well.
Counsel for the petitioners have submitted that as per the allegations in the FIR, registered on the statement of the complainant HC Beant Singh, on 20.05.2018, he was present in the Police Station when the petitioners came there and enquired about a complaint made by them. Thereafter, when he was going on a motorcycle, the petitioners intercepted and caused injuries to him with intention to kill. Counsel for the petitioners have further submitted that the petitioners are in custody since 07.06.2018; the investigation is complete; challan stands presented and the case is at the stage of recording the evidence of the prosecution and it will take some time in conclusion of the trial.
Counsel for the petitioners, at this stage, submits that the petitioners are ready to compensate the complainant HC Beant Singh, who is present in the Court by paying him an amount of Rs.25,000/- each on account of his medical expenses.
Counsel for the petitioners have handed over 02 demand drafts of Rs.25,000/- to the complainant - HC Beant Singh (a photocopy of the same is taken on record as Mark B), which is accepted by him.
Without commenting anything on merits of the case, considering the fact that the petitioners have compensated the complainant; they are not involved in any other case; the petitioners are in custody since 07.06.2018; the case is still at the stage of recording the evidence of the prosecution; the material witnesses have already been examined and conclusion of the trial is likely to take some time,
these petitions are allowed and the petitioners are directed to be released on bail subject to their furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate. However, it will be open for the prosecution to apply for cancellation of bail of the petitioners, in case they are found involved in any other case or misusing the concession of bail, in any manner.
