Learned counsel for the petitioner submits that respondent No.2 is proforma respondent, as such, his service may be dispensed with. Request allowed.

Mr. Prateek Pandit, Advocate has put in appearance on behalf of respondent No.1, filed power of attorney and submits that he has no objection if the petitioner is allowed to examine Narinder Kumar @ Sunny by providing him one opportunity as the ejectment petition is ripe for final arguments.

In view of submission of learned counsel for respondent No.1, this petition is allowed on following terms:- (i) the revision petitioner-tenant will file affidavit of Narinder Kumar @ Sunny about his examination-in-chief, if not filed earlier, within a week from today with advance copy to counsel for the landlord. CR-7828-2018 -2of failure of revision petitioner in filing affidavit of Narinder Kumar @ Sunny within a week, he will not be allowed to examine Narinder Kumar @ Sunny.

(ii) On filing of affidavit of Narinder Kumar @ Sunny within a week and supplying copy, learned Rent Controller will provide one opportunity to revision petitioner-tenant to produce this witness for his statement and cross-examination. No further opportunity for this purpose shall be allowed.
